Agreement to Terms
By accessing Orange Panda Fit facilities, using our website, or engaging with our services, you agree to be bound by these Terms of Service. Please read them carefully before using our services.
Membership and Services
Membership Types
We offer the following membership options:
- Credits: Non-expiring credits that can be used for private training sessions
- Monthly Memberships: Recurring subscriptions providing access to facility and group classes
Credit System
- 1 credit equals $1 in value
- Credits never expire
- Credits can be used for private training sessions and other services
- Minimum account balance allowed: -50 credits
- Credits are non-refundable but transferable to other members upon request
Monthly Memberships
- Memberships are billed monthly through Stripe
- First month may be pro-rated based on sign-up date
- Memberships include access to facility and group classes
- Membership benefits vary by plan type
Booking and Cancellation
Private Sessions
- Private training sessions are 1 hour in duration
- Cancellation Policy: Sessions must be cancelled at least 2 hours before the scheduled start time
- Late cancellations or no-shows will result in full session charges
- Sessions can be rescheduled subject to trainer availability
Group Classes
- Group classes operate on a capacity-limited, first-come-first-served basis
- Waitlist positions are honored in order when spots become available
- Classes may be cancelled or rescheduled due to low enrollment or unforeseen circumstances
- Members will be notified of any class changes as soon as possible
Facility Rules and Conduct
Health and Safety
By using our facilities, you confirm that:
- You are in good physical health and capable of participating in exercise activities
- You have consulted with a physician if you have any medical conditions that may affect your ability to exercise
- You will immediately notify staff of any injuries, discomfort, or medical emergencies
- You will follow all posted safety guidelines and equipment instructions
Member Conduct
All members must:
- Treat staff and other members with respect and courtesy
- Wear appropriate workout attire and closed-toe athletic shoes
- Clean and sanitize equipment after use
- Return equipment to designated areas after use
- Refrain from using mobile phones in workout areas (except for music/apps)
- Not engage in harassment, discrimination, or disruptive behavior
Photography and Recording
- Photography and video recording are prohibited without prior written consent
- Use of cameras in locker rooms and restrooms is strictly prohibited
- Violations may result in immediate termination of membership
Assumption of Risk and Liability Waiver
Acknowledgment of Risk
By using our facilities and services, you acknowledge that:
- Physical exercise involves inherent risks of injury
- You voluntarily assume all risks associated with fitness activities
- You are responsible for your own safety while using the facility
- Personal training involves physical contact for form correction and spotting
Limitation of Liability
Orange Panda Fit, its owners, employees, and trainers shall not be liable for:
- Injuries sustained during exercise or use of equipment
- Loss, theft, or damage to personal belongings
- Injuries resulting from failure to follow instructions or safety guidelines
This limitation does not apply to injuries caused by our gross negligence or willful misconduct.
Payment Terms
Credit Purchases
- Credit purchases are processed as one-time payments through Stripe
- All credit purchases are final and non-refundable
- Credits will be added to your account immediately upon successful payment
Membership Billing
- Memberships are automatically renewed on a monthly basis
- Payment is due on the same date each month
- Failed payments may result in temporary suspension of membership privileges
- You are responsible for maintaining current payment information
Refunds
- Unused credits are non-refundable
- Membership cancellations require 30 days notice
- Pro-rated refunds may be available at management discretion for extenuating circumstances
- Refund requests must be submitted in writing
Account Termination
Voluntary Cancellation
- You may cancel your membership at any time with 30 days notice
- Cancellation requests must be submitted through your member portal or in writing
- Any outstanding balance must be paid before cancellation is processed
Termination by Orange Panda Fit
We reserve the right to terminate or suspend your membership for:
- Violation of these Terms of Service
- Failure to pay outstanding balances
- Behavior that endangers staff, members, or property
- Misuse of facilities or equipment
Intellectual Property
All content on our website, including text, graphics, logos, and images, is the property of Orange Panda Fit and protected by copyright laws. You may not reproduce, distribute, or create derivative works without our written permission.
Modifications to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be posted on our website with an updated "Last Updated" date. Continued use of our services after changes constitutes acceptance of the new terms.
Governing Law
These Terms of Service are governed by the laws of the State of California. Any disputes shall be resolved in the courts located in Orange County, California.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
